Creamy Skincare Ambassador Terms & Conditions

Welcome to the Creamy Skincare Ambassador Program!
Our company is dedicated to providing high-quality skincare products from Brazil to customers around the world. Since we don’t know each of our ambassadors personally, we’ve created these terms to set clear expectations.

When we say “Company”, “we”, “our”, or “us” in this document, we are referring to Creamy Skincare LLC.
When we say “Services”, we mean any skincare product created, imported, and/or maintained by the Company.

These terms may be updated at any time in the future. Updates will be communicated by email.
Please read this document carefully before accepting to become an ambassador of the Company.

1. Eligibility

To become an ambassador of the Company, you must:

Be 18 years of age or older.
Have read, understood, and agreed to these terms.
Be in good standing with the Federal Trade Commission (FTC).
Own and maintain active social media accounts.

2. Engagement

As a brand ambassador of the Company, you agree to:

Create, post, and share content that promotes the Company’s products.
Promote your unique promo code to increase sales for the Company.
Collaborate with other ambassadors when requested.
Occasionally attend events, if invited by the Company.

3. Restrictions

As a brand ambassador you agree not to:

Make any guarantees, representations, or warranties on behalf of the Company, other than those provided in the official marketing material.
Spam or promote the Company in ways that violate any laws or regulations.
Promote the Company in any sexually explicit, violent, political, discriminatory, unlawful, threatening, or otherwise objectionable content — subject to the sole discretion of the Company.
Use the Company’s brand, image, or likeness on your own website in ways that may cause customer confusion.
Run paid advertising campaigns with your promo codes.
Engage in fraudulent activity to artificially inflate social media metrics (likes, follows, shares, views, etc.).
Create multiple ambassador accounts or use more than one promo code.
Misrepresent or modify the price of the Company’s products.

The Company reserves the right to request removal or modification of any ambassador content at its sole discretion.

4. Disclosure

Ambassadors must disclose their material connection with the Company when posting content.
You may use text such as #sponsored or #ad to clearly disclose this relationship, in compliance with FTC guidelines.

5. Compensation

Ambassadors will receive 20% commission on every sale generated through their promo code.
Commission is calculated on the order subtotal, excluding taxes and shipping.
Commissions are paid monthly via PayPal once they exceed USD $20.
Ambassadors are solely responsible for reporting and paying any and all tax obligations.

6. Intellectual Property Rights

Ambassador content: By joining the program, you grant the Company a worldwide, irrevocable, sub-licensable, non-exclusive license to use the content you create to promote the Company’s products in any media, in whole or in part, in perpetuity. This includes, but is not limited to, social media, advertising, publications, and marketing material.
Company content: The Company grants ambassadors a non-exclusive, non-transferable, revocable, limited license to use the Company’s name, logo, slogans, promo codes, likeness, and other advertising material solely for the purposes of this program. All rights remain with the Company.

7. Termination

The Company may terminate this agreement and your participation in the ambassador program at any time, with or without cause.
Ambassadors may terminate their participation by providing 30 days’ written notice.

8. Non-Compete

While participating in the Creamy Skincare Ambassador Program, ambassadors may not promote or advertise competing skincare or cosmetic brands that directly conflict with the Company’s product line.

9. Liability Limitations

You expressly agree and understand that the Company shall not be liable to you or any third party for any direct, indirect, incidental, or consequential damages, including but not limited to loss of profit, goodwill, or other intangible losses resulting from participation in the ambassador program.
